Since I won the loser’s lottery having been summoned for jury duty in Wake County next week, I’ve done a bit of research on what is expected of me.
Apparently jurors are sworn to keep secret all of the proceedings and are prohibited from:
- Checking facts online or in person
- Doing any research abut the case, the people involved, the histories etc.
- Discussing the case with anyone – including friends, family, fellow jurors, attorneys
If this is supposed to ensure justice is delivered fairly and impartially, I must disagree. I make decisions based on facts. I employ reasoning, gather evidence, review historical data and talk through my logic with others.
It seems to be the best way for me to make well informed, reasonably thoughtful decisions.
I remember years ago that some courtrooms prohibited jurors from taking notes during the trial. I’m not sure if that’s the case here in Wake County.
But if that is true, it seems like an absolutely ridiculous prohibition. I take notes during classes. I take notes when a repairman offers an estimate. I take notes when I see a doctor. Why wouldn’t I want to take notes during a trial, when critical facts and details could impact another person’s freedom, finances or future?
It’s obvious I’m not pleased to be summoned. I am still hoping I get dismissed the night before or on the first day of jury selection.
I don’t believe it is my “duty” to serve. I don’t believe it is some higher moral calling. I think the criminal justice system , the civil justice system, the prison system and policing are all highly flawed, self serving institutions that are primarily used as mechanisms to collect tax revenues in the form of fines, fees and court costs.
I have some opinions on how all of these institutions could be improved, but nobody’s asked for my input. And my opinions are not based on any personal expertise – they are as useless as most uniformed opinions.
Still, I will follow the rules, because I do not want to suffer the consequences of not following them – fines, jail time, being held in contempt of court etc.
In other words, I will be compliant under the threat of duress.
I suspect some percentage of my fellow jurors are doing the same.
So much for fair, impartial and just.
